Régimen de Origen/Origin Regime
Para entender qué es un Régimen de Origen es necesario hacer referencia a la noción de Acuerdo Comercial entre los países. Los Acuerdos Comerciales constituyen el medio por el cual los países firmantes se otorgan entre sí tratamientos arancelarios preferenciales para el intercambio de sus mercaderías. Ahora bien, ¿cómo se garantiza que las preferencias negociadas se apliquen exclusivamente a las mercaderías originarias de los países signatarios del Acuerdo, y no a mercaderías de terceros países?: mediante el funcionamiento de un Régimen de Origen que determine los criterios de calificación para que una mercadería sea considerada originaria.
Entonces, en síntesis, el Régimen de Origen es un sistema normativo (conjunto de normas y procedimientos) cuyo objetivo es lograr la correcta aplicación de las preferencias a las mercaderías "originarias" de los países firmantes de un Acuerdo Comercial. Generalmente cada Acuerdo establece su propio Régimen de Origen. Este tema a su vez nos introduce necesariamente a otra de las expresiones comúnmente utilizadas en comercio exterior: Normas de Origen.
In order to understand what is an Origin Regime it is necessary to refer to the notion of Commercial Agreement between countries. The Commercial Agreements are the means by which the signatory countries grant themselves preferential duty treatments for the exchange of their merchandises. Well, how do we warranty that the negotiated preferences are applied exclusively to the original merchandises of the signatory countries of the Agreement, and not to merchandises form third countries? : by means of the functioning of an Origin Regime that determines the qualifying criteria for a merchandise to be considered original.
Then,
in synthesis, the Origin Regime is a system of rules (set of standards
and procedures) having the target to achieve the correct application of
the preferences to the "original" merchandises of the signatory
countries of a Commercial Agreement. Usually each Agreement establishes
its own Origin Regime. This subject in its turn necessarily introduces
us to other common expression used in foreign trade: Origin Standards.
